Required Florida Auto Coverage
Knowing and understanding Florida's state-mandated auto insurance requirements is vital when shopping for Florida auto insurance. The following coverage is mandatory:
- At least $10,000 in Personal Injury Protection (PIP). This insurance covers you in an accident regardless of who is at fault, and pays for portions of costs such as medical expenses, lost wages, and resulting child autoe expenses. PIP also pays a $5,000 death benefit.
- $10,000 in Property Damage Liability (PDL). This portion pays for damage you or a family member cause others while driving your auto. "Property" includes fences, buildings, autos and telephone poles.
Additional types of Florida auto insurance such as Bodily Injury Liability, Collision, Comprehensive or Uninsured/Underinsured Motorist coverage are also available-but these are optional, your lender or leasing agent requires them.
Your Responsibilities and Rights
As a Florida auto insurance consumer, the state places certain responsibilities in your hands. For example, you have the responsibility to read and understand your Florida auto insurance policy, and to ask your agent or insurance company to clarify anything you do not understand. It is your responsibility to fill out your insurance application completely and accurately; to verify the licensing of any and all insurance companies and agents with whom you are considering doing business; and to obtain adequate auto insurance as defined by the state of Florida.
Once you have purchased your Florida auto insurance policy, it is your responsibility to ask your insurance company or agent for proof of coverage until you receive your policy; keep track of your policy renewal date so you can make all payments on time and avoid the risk of nonrenewal; pay any additional premium costs; and report any changes affecting your policy to your company or agent as they occur.
Always remember it is your responsibility to make contact with your insurance company or agent right away following an accident. This ensures that your Florida auto insurance claim is processed immediately.
Report any suspected fraud to the Florida Department of Financial Services by calling the Fraud Hotline at 800-378-0445.
Your rights as a Florida auto insurance consumer are also numerous. It is your right to choose your own insurance company and agent, and to obtain a fair insurance quote. You have the right to purchase your policy with no preferential treatment or discrimination.
When filing a claim, you have the right to have that claim investigated in a proper and timely manner, and to acquire payment for necessary repairs from your insurance company or agent within 20 days of a settlement. You are entitled to receive copies of all insurance forms and applications within 60 days and, if not satisfied with your insurance provider, you may file a complaint regarding those issues with your insurance company.
Nonrenewal/Interrupted Coverage
It is important to stay current on new state requirements and insurance payments to avoid nonrenewal or unnecessary interruptions in your Florida auto insurance coverage.
Your Florida auto insurance company may nonrenew your auto insurance policy for several reasons, including excessive claims or accidents, nonpayment, traffic violations or failure to obtain new auto insurance coverage. If your Florida auto insurance policy is cancelled, the Florida Department of Highway Safety and Motor Vehicles will suspend your driver's license, registration and auto tag. Fines may also be assessed.
